Our client was charged with threatening a girlfriend with a weapon and continuing to stalk to her. The aggravated assault charge carried a presumptive imprisonment sentence. Client had no prior record. The case was handled by Tricia Bath who advised the prosecutors that the client would not plead to a felony charge.

Wyandotte County prosecutors insisted upon a felony charge. The matter was taken to trial in late 2014. The prosecutor’s violated a Motion in Limine and the court declared a mistrial. The prosecutor then amended the complaint to increase the charges. The client refused plea negotiations and the matter was tried again in the spring of 2015. The client was acquitted of all charges.
